The German version of these terms is legally binding. This English version is provided for convenience.

§ 1 Scope

These terms apply to all orders placed by consumers via merrymory.com with PLACEHOLDER: Company name ("we").

§ 2 Contract

The product presentation in the shop is not a binding offer. By clicking "Buy now" you submit a binding order. The contract is concluded when we confirm the order by email after successful payment. The contract language is German or English. We store the contract text; you receive the order details and these terms by email.

§ 3 Product

• MerryMory is a Christmas bauble with a round display and speaker that is loaded with your personal song and photos.
• Lyrics and music are created with the help of AI on the basis of your input. Results may vary; you can review lyrics and song before ordering and the order covers the version you approve.
• Power is supplied by 3 × AAA batteries, which are not included.
• Product images on this website are partly visualisations; colours and details may differ slightly.

§ 4 Prices and shipping costs

All prices include statutory VAT. Shipping costs are shown before you order. We currently deliver to Germany only. Further countries are only offered once shipping costs and taxes for them have been configured.

§ 5 Payment

Payment is processed by Stripe. Available payment methods are shown at checkout. Production starts once payment has been received.

§ 6 Delivery

Orders can be placed until 16 December 2026 at 23:59 (Europe/Berlin). Shipping starts in early December. Stated delivery times are estimates; we do not guarantee delivery before Christmas.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal, subject to the exceptions described in the withdrawal policy. Goods made to the customer's specifications or clearly tailored to personal needs may be excluded (§ 312g(2) no. 1 BGB).

§ 8 Your content

• You warrant that you hold the rights to the photos and texts you upload and that they do not infringe third-party rights. Please do not upload content showing other people without their consent.
• You grant us a simple, non-transferable right to use your content solely to create, produce and deliver your order.
• You may use the song created for your order for private, non-commercial purposes. We cannot promise exclusive copyright in AI-generated content; similar results for other customers cannot be ruled out.
• We may refuse content that is illegal, offensive or infringes rights.

§ 9 Warranty and liability

Statutory warranty rights apply. We are liable without limitation for intent, gross negligence and injury to life, body or health; otherwise in accordance with statutory provisions.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
